SO IT'S OUR HONOR TO DO A PROCLAMATION FOR OUR PUBLIC WORKS PROFESSIONALS.

I'LL START THIS OFF WITH THIS PHRASE ROOTED IN SERVICE POWERED BY COMMUNITY.

WHEREAS, PUBLIC WORKS PROFESSIONALS PLAY AN ESSENTIAL ROLE IN MAINTAINING THE INFRASTRUCTURE, FACILITIES, AND SERVICES THAT SUPPORT THE HEALTH, SAFETY AND QUALITY OF LIFE FOR THE CITIZENS OF DECATUR.

WHEREAS, THE DEDICATED PROFESSIONALS PLAN, BUILD, OPERATE AND MAINTAIN CRITICAL SYSTEMS INCLUDING STREETS, WATER AND WASTEWATER, UTILITIES, STORM DRAINAGE, PUBLIC BUILDINGS AND OTHER VITAL COMMUNITY ASSETS THAT KEEP OUR CITY FUNCTIONING EVERY DAY. AND WHEREAS, PUBLIC WORKS EMPLOYEES DEMONSTRATE INNOVATION, SKILL AND COMMITMENT TO PROVIDING RESILIENCE AND SUSTAINABLE SERVICES THAT STRENGTHEN OUR COMMUNITY TODAY AND FOR FUTURE GENERATIONS.

AND WHEREAS, PUBLIC AWARENESS AND UNDERSTANDING OF PUBLIC WORKS PROGRAMS HELP FOSTER APPRECIATION FOR THE VITAL CONTRIBUTIONS THESE PROFESSIONALS MAKE ON A DAILY BASIS AND AFFECTING THE LIVES OF ALL CITIZENS.

WHEREAS, THE YEAR 2026 MARKS THE 66TH ANNUAL NATIONAL PUBLIC WORKS WEEK SPONSORED BY THE AMERICAN PUBLIC WORKS ASSOCIATION. NOW, THEREFORE, I, MIKE MCQUISTON, MAYOR OF THE CITY OF DECATUR, DO HEREBY PROCLAIM MAY 17TH THROUGH 23RD NATIONAL PUBLIC WORKS WEEK.

OFFICERS WHO FAITHFULLY SERVE WITH INTEGRITY AND COURAGE.

AND WHEREAS LAW ENFORCEMENT OFFICERS PLAY A VITAL ROLE IN SAFEGUARDING OUR NEIGHBORHOODS, PROTECTING OUR CITIZENS, AND UPHOLDING THE RULE OF LAW. AND WHEREAS, THE MEMBERS OF THE DECATUR POLICE DEPARTMENT WORK TIRELESSLY TO PROTECT LIFE AND PROPERTY, PRESERVE PEACE, AND BUILD TRUST THROUGH SERVICES TO OUR RESIDENTS.

AND WHEREAS, NATIONAL POLICE WEEK PROVIDES AN OPPORTUNITY TO RECOGNIZE THE DEDICATED MEN AND WOMEN OF LAW ENFORCEMENT WHOSE DAILY EFFORTS STRENGTHEN OUR COMMUNITY AND UPHOLD THE PRINCIPLES OF JUSTICE. WHEREAS PEACE OFFICERS MEMORIAL DAY OBSERVED EACH YEAR ON MAY 15TH HONORS THOSE OFFICERS WHO HAVE GIVEN THEIR LIVES OR SUFFERED INJURY IN THE PERFORMANCE OF THEIR DUTIES.

WHEREAS THE CITY DECATUR IS PROUD TO RECOGNIZE THE SERVICE, SACRIFICE AND UNWAVERING DEDICATION OF THE DECATUR POLICE DEPARTMENT, WHOSE EFFORTS AND CONTRIBUTIONS TO THE QUALITY OF LIFE BY ALL WHO LIVE HERE WHILE WE WORK AND THOSE WHO ARE VISITING OUR CITY.

WE'RE OUT OF PLAINVIEW, TEXAS, UP IN THE PANHANDLE.

WE DISTRIBUTE GASOLINE, DIESEL AND MR. RAJ, JOSHI ON THIS ACTION ITEM NUMBER ONE RETAINED US AS A CONSULTANT AND GAS A FUEL SUPPLIER FOR THEIR PROPOSED GASOLINE STATION.

AND MR. JOSHI CAME IN TO YOUR CITY AND BOUGHT A PIECE OF PROPERTY THAT HAD A BURNED OUT BUILDING OUT ON HIGHWAY 51 THAT WAS RAT INFESTED AND HAD LEAKING GASOLINE TANKS.

AND AGAINST OTHER ADVICE HE ACTUALLY HE TOOK, HE PUT HIS OWN MONEY IN THAT AND CLEANED IT UP AND RAN THE RATS OFF AND DUG UP THE GASOLINE TANKS THAT WERE LEAKING AND REMEDIATED THE SITE TO THE TCEQ SPECIFICATIONS AND HAS SPENT SEVERAL HUNDRED THOUSAND DOLLARS.

AND NOW HE WANTS TO PUT A NICE CONVENIENCE STORE.

THEY RUN A VERY WELL RUN BUSINESS. THEY HAD THEY JUST BUILT ONE IN BRIDGEPORT.

IF YOU'RE FAMILIAR WITH ONE ON WHOLESALE AND THE 101 THAT GOES AROUND INSIDE BRIDGEPORT, THEY BUILT, HE BUILDS A VERY BEAUTIFUL STATION. WE'RE SURPRISED THAT PEOPLE IN THE NEIGHBORHOOD ARE AGAINST IT FOR TRAFFIC REASONS.

THE TRAFFIC IT WHAT HE'S BUILDING OR INTENDS TO BUILD IS NOT A DESTINATION.

IT'S NOT GOING TO CREATE TRAFFIC. THE TRAFFIC'S ALREADY THERE.

AND OF COURSE, THE FAIRGROUNDS ACROSS THE STREET.

AND SO THE TRAFFIC, THERE'S NOT GOING TO BE ANY EXTRA TRAFFIC AND THE PEOPLE GOING INTO THE NEIGHBORHOOD OR GOING THERE ANYWAY.

AND SO IT'S, IT'S A BUSINESS AND A PIECE OF PROPERTY THAT A PROPOSED BUSINESS, A PIECE OF PROPERTY THAT HE'S WILLING TO SPEND SOMEWHERE BETWEEN A MILLION AND A HALF AND $2 MILLION AND CREATE SOMETHING AROUND A MILLION AND A HALF DOLLARS WORTH OF SALES, A TAXABLE SALES A YEAR. AND FRANKLY, YOU GUYS HAVE TO, AND LADIES, HAVE TO MAKE DIFFICULT DECISIONS.

AND I DON'T THINK THAT VERY MANY CITIES ARE JUST SWIMMING IN MONEY, ESPECIALLY A GROWTH AREA LIKE THIS.

AND SO IT, I CAN'T THINK THAT THE ONLY FISCAL RESPONSIBLE DECISION WOULD BE MADE TO ALLOW A BUSINESS LIKE THIS TO COME IN. I THINK IF YOU TOOK A POLL OF THE KIDS IN THE NEIGHBORHOOD TO BE ABLE TO RUN AROUND THE CORNER AND GET THEM AN ICE CREAM CONE OR A CANDY BAR OR A COKE, RATHER THAN ASK MOTHER AND DAD TO RUN THEM DOWN TO WALMART, I THINK YOU'D IF YOU TOOK THE VOTE FROM THEM, I THINK YOU'D GET YOUR ANSWER PRETTY QUICK. BUT WE ALL GREW UP IN NEIGHBORHOODS THAT HAD LITTLE GROCERY STORES CLOSE.

WE BELIEVE THAT THAT SIDE OF TOWN NEEDS IT. THE CLOSEST PLACE FOR GASOLINE AND SNACKS IS UP ON THE INTERSTATE OR UP ON 281.

AND OF COURSE, THE WALMART AND. MR. GARRISON, YOUR TIME IS UP.

IT IS THE GASOLINE SALES AND THE RESTRICTED BUSINESS DISTRICT THAT REQUIRES THE SPECIFIC USE PERMIT.

SO IN OUR CODE OF ORDINANCES, ARTICLE 5, SECTION 5.2.5, DOES ALLOW COUNCIL TO APPROVE, APPROVE WITH CONDITIONS OR DENY SPECIFIC USE PERMITS. SO SOME QUESTIONS CAME UP AT THE LAST COUNCIL MEETING ABOUT WHEN IT WAS ZONED AND HOW IT WAS ZONED.

SO WE PULLED SOME OLD INFORMATION AND IN 1976 IT WAS ZONED SINGLE FAMILY.

IT'S THAT LITTLE SLIVER TRIANGLE WITH THE CIRCLE RED CIRCLE AROUND IT.

AND IN 1977, AT THE REQUEST OF J. G.R LIPSEY, IT WAS REZONED FROM SINGLE FAMILY 2 TO COMMERCIAL.

AND THE PURPOSE OF THAT WAS FOR A CONVENIENCE STORE.

AND IT STATES THAT IN THE MINUTES THAT ARE INCLUDED RIGHT THERE.

ALSO WHEN THIS WENT THROUGH THE REZONING AT THAT TIME, THEY DID RECEIVE A LETTER, A PETITION OF NO OBJECTION, WHICH WAS PRESENTED TO THE CITY COUNCIL IN 1977.

SO THE LAND USE MAPS IN 2006 SHOWS THAT ALL OF THAT WAS IN IN A COMMERCIAL ZONING DISTRICT.

IT IS CONSISTENT WITH OUR COMPREHENSIVE PLAN.

THE EXISTING LAND USE IS COMMUNITY COMMERCIAL, WHICH ALLOWS PRIMARY USE OF RETAIL AND COMMERCIAL.

SO THIS PROJECT WAS APPROVED IN 2023. THE BUILDING PERMIT APPLICATION EXPIRED IN SEPTEMBER OF 2025, WHICH MADE THE PLAT AND ALL OTHER APPROVALS EXPIRE AT THE SAME TIME.

SO WE'RE COMING BACK FOR THE NEW APPROVALS ON THIS.

SO THE REPLAT WAS APPROVED BY CITY COUNCIL IN NOVEMBER OF LAST YEAR IN 2025, AGAIN AT C-1 RESTRICTED BUSINESS WHICH REQUIRES A SPECIFIC USE PERMIT FOR THE GASOLINE SALES. IT DID APPEAR BEFORE THE CITY COUNCIL JANUARY 12TH, BUT IT DID NOT RECEIVE ENOUGH OF THE VOTES.

IT REQUIRED 75% OF THE COUNCIL TO APPROVE IT.

IT FELL SHORT. THE SPECIFIC USE PERMIT FOR BEER AND WINE SALES FOR OFF PREMISE CONSUMPTION WAS APPROVED AT THAT MEETING.

SO AFTER THAT MEETING, THE PROPERTY OWNER AND APPLICANT HAD A NEIGHBORHOOD MEETING IN FEBRUARY.

IT WAS NOON TO TWO. IT WAS IN PERSON AND HAD THE ABILITY TO HAVE PEOPLE JOIN IN VIRTUALLY.

AS STATED EARLIER, IT DID HAVE A CONVENIENCE STORE ON IT BACK IN THE 90S UNTIL APPROXIMATELY 2014, WHEN IT WAS DAMAGED BY FIRE AND THEN DEMOLISHED.

SO IN 2023, WHEN IT CAME BEFORE US FOR DEVELOPMENT, A VARIANCE WAS REQUESTED FOR PARKING.

HOWEVER, THAT WAS TABLED WHEN THEY BROUGHT THE PROJECT BACK LATE LAST YEAR, THE NEW PLANS REMOVED ONE OF THE GAS PUMPS, WHICH MADE THE PARKING COMPLIANT WITH THE CODES.

SO THE PROPOSED DEVELOPMENT WILL HAVE TO MEET ALL OF THE DEVELOPMENT STANDARDS OF THE ZONING ORDINANCE, INCLUDING LIGHTS, LIGHTING, NO SPILLAGES PERMITTED INTO THE NEIGHBORHOOD, BUFFERING, LANDSCAPE, FENCING AND WALLS. AND THOSE ARE TO BE MAINTAINED IN PERPETUITY AND WILL BE REVIEWED AT THE TIME THE BUILDING PERMITS ARE SUBMITTED AT CIVIL PLANS REVIEW AND BUILDING PERMIT. SO HERE'S JUST A FEW PICTURES OF THE PROPOSED DEVELOPMENT.

WE'VE GOT SOME 3D RENDERINGS PROVIDED BY THE APPLICANT.

SO PER THE STATUTE, STATE STATUTORY REQUIREMENTS WERE REQUIRED TO NOTIFY PROPERTY OWNERS WITHIN 200FT.

THOSE WERE NOTIFIED VIA U.S. POSTAL SERVICE, AS WELL AS THE STATE STATUTES CHANGED IN JULY OF LAST YEAR.

AND WE HAVE TO POST THE PROPERTY FOR ANY TYPE OF ZONING CHANGE.

SO WE DID RECEIVE FIVE OPPOSITIONS. THAT'S 35.02%.

THAT MEANS THAT THIS WILL REQUIRE 75% OF APPROVAL VOTE BY CITY COUNCIL.

SOME OF THE OPPOSITION REASONS WERE DECREASED PROPERTY VALUES, SAFETY, TRAFFIC, PARKING DISRUPTIVE TO THE NEIGHBORHOOD.

WE ALSO, AT THE APRIL 27TH COUNCIL MEETING RECEIVED A PETITION, YOU'LL SEE ALL THE RED ON THERE FOR THE PETITION, BUT IT DIDN'T CHANGE THE PERCENTAGE BECAUSE YOU'LL SEE THE RED CIRCLE THAT SHOWS THE 200FT.

SO AGAIN, THOSE REASONS CITED AGAINST TRAFFIC SAFETY, PEDESTRIAN SAFETY, NOISE AND BRIGHT LIGHTS, PROPERTY VALUES, LITTER, PUBLIC BEHAVIOR AND EXISTING CONGESTION.

JUST A QUESTION FOR THE GREEN, THOSE, YOU HAVE READ THERE, BUT YOU ALSO HAVE A GREEN HIGHLIGHTED.

BUILDING PERMITS WILL BE REQUIRED AS WELL AS CIVIL PLANS BEFORE COMMENCEMENT OF CONSTRUCTION.

THEY DID BRING UP SOME ADDITIONAL PARKING CONCERNS AND REQUESTED THAT NO PARKING SIGNS BE PLACED ALONG JOHN AVENUE UP INTO THE NEIGHBORHOOD.

PARKING IN THE RIGHT OF WAY IS CURRENTLY PERMITTED.

BLOCKING ANY DRIVEWAYS OR SIDEWALKS IS PROHIBITED.

WE REACHED OUT TO POLICE AND FIRE, THEY'RE CONCERNED WITH PUTTING NO PARKING SIGNS THERE WAS THAT IT WOULD POTENTIALLY DRIVE ADDITIONAL PEOPLE INTO THE NEIGHBORHOODS LOOKING TO PARK, BECAUSE IF THEY CAN GO AHEAD AND PARK ALONG THE RIGHT OF WAY LEGALLY ON JOHN AVENUE, THEN HOPEFULLY IT WOULD KEEP THEM OUT OF THE NEIGHBORHOOD.

DUE TO THE CLOSE PROXIMITY OF THE CONVENIENCE STORE TO OUR HOMES WE ASKED THE CITY TO REQUIRE A MINIMUM OF TEN-FEET TALL FENCE CONSTRUCTED WITH DURABLE NOISE REDUCING MATERIALS SUCH AS CONCRETE, BRICK OR OTHER COMMERCIAL SOUND BARRIER MATERIALS INSTEAD OF THE WOOD FENCING.

OUR NEIGHBORHOOD DESERVES MEANINGFUL PROTECTION IF THIS DEVELOPMENT MOVES FORWARD.

WE RESPECTFULLY ASK THAT THE CITY REQUIRE STRONGER BUFFERING STANDARDS TO PROTECT HOMEOWNERS QUALITY OF LIFE AND PRESERVE THE CHARACTER OF THE RESIDENTIAL AREA.

AND THEN BUSINESS 380 ALL THE WAY OUT TO INTERSTATE 380 AT THE PALOMA SUBDIVISION.

AND IF YOU WILL LOOK ON THE NORTH SIDE OF BUSINESS 380 THROUGH THIS PORTION, IT IS ALL ZONED HEAVY INDUSTRIAL AND COMMERCIAL.

AND IF YOU LOOK ON THE SOUTH SIDE, OTHER THAN THE PALOMA DEVELOPMENT, WHICH I'M NOT SURE WHAT'S GOING TO GO THERE RIGHT AT THAT INTERSECTION, EVERYTHING ON THE SOUTH SIDE OF BUSINESS 380, ON THIS PORTION OF BUSINESS 380 IS ZONED EITHER COMMERCIAL OR LIGHT INDUSTRIAL, OTHER THAN THREE LOTS. ONE LOT IS OCCUPIED BY A CHURCH AND THE OTHER ONE IS OCCUPIED BY A HOUSE.

SO IF APPROVING, EXCUSE ME, APPROVING THIS ZONING CHANGE, MEANS THAT LIKELY WELL INTO THE FUTURE ALONG BOTH SIDES OF BUSINESS 380. AT THIS PORTION OF BUSINESS 380 THERE'S GOING TO BE TWO HOUSES AND EVERYTHING ELSE UP AND DOWN THIS ROAD IS GOING TO BE COMMERCIAL, LIGHT, INDUSTRIAL RETAIL, SOME OTHER SIMILAR TYPE USE.

FY 26, WE PUT THAT BUDGET TOGETHER WITH A VALUE, A TAXABLE VALUE OF $1,495,281,348. AND THAT WAS AN INCREASE FROM FY 25 OF ABOUT 7.5%. AND WHERE WE SIT TODAY, AND I HOPE THIS DOESN'T SHOCK ANY OF YOU, BUT WHERE WE SET TODAY IS MUCH LIKE WHERE SOME OF OUR PARTNER CITIES AND OUR BENCHMARKING CITIES ARE SETTING, WE'RE ACTUALLY AT A 2.5% DECREASE OVERALL.

SO TODAY'S PRELIMINARY ESTIMATED VALUE, TAXABLE VALUE IS ACTUALLY DOWN TO $1,456,964,250. AND I'M GOING TO KIND OF UNPACK HOW THAT'S EVEN POSSIBLE ON THE NEXT SLIDE.

BUT I DO WANT TO POINT OUT THAT WE HAD A GREAT AMOUNT OF NEW CONSTRUCTION COMING ONLINE, WHICH IS SOMETHING WE ALWAYS LOOK FORWARD TO.

I KNOW MY DECATUR FRIENDS LOVE HEARING THAT. IT'S ALMOST REUNION TIME.

WE CRINGE BECAUSE THAT MEANS BUDGET IS HERE. SO WHEN WE TAKE THAT PRELIMINARY NUMBER AND WE PUT IT ON A CHART AND WE KIND OF LOOK BACK HISTORICALLY, WHAT HAVE WE DONE HISTORICALLY? WELL, HISTORICALLY, DECATUR HAS DONE QUITE WELL IN MAINTAINING CERTIFIED TAXABLE VALUE.

I AM A LITTLE SHOCKED THAT WE'RE BASICALLY FLAT AT THE MOMENT.

BUT YOU CAN SEE IF WE LOOK BACK INTO 2021, YOU CAN KIND OF SEE WHERE WE DIPPED A LITTLE BIT.

BUT THEN FROM THAT POINT, WE HAVE CONTINUED JUST TO STEADILY AND I THINK VERY CONSERVATIVELY GROW THE TAXABLE VALUE PICTURE.

AND I FEEL LIKE WE WILL RECOVER. BUT THERE'S AN ITEM THAT I WANT TO POINT OUT THAT'S IT'S, HOUSE BILL NINE. AND WE'RE ALL KIND OF STILL GETTING OUR HEAD WRAPPED AROUND THIS.

AND WHEN I, AND WHEN I SAY WE, I MEAN MANAGERS, CITY MANAGERS THAT ARE PUTTING TOGETHER THEIR PRELIMINARY BUDGETS AT THE MOMENT.

SO HOUSE BILL NINE ALLOWED FOR A GREAT REDUCTION IN TAXABLE PERSONAL PROPERTY.

AND WHAT THAT DID IS IT ALLOWED THAT EXEMPTION TO GO FROM $2500 TO $125,000 FOR SOMEONE WHO HAD A BUSINESS PROPERTY.

AND SO THAT IMMEDIATELY TOOK ALL THAT NEW CONSTRUCTION THAT WE TALKED ABOUT AND BEGAN TO CHIP AWAY AT IT INCREDIBLY, WHEN WE LOOK AT DECATUR'S OVERALL TAXABLE VALUE.

AND SO REALLY WHAT THAT DOES IS IT JUST PUTS A LOT OF PRESSURE ON M AND O DOLLARS GENERAL FUND MAINTENANCE AND OPERATION DOLLARS.

AND IF YOU'LL REMEMBER, WE TALK ABOUT THE DIFFERENCE BETWEEN STATE'S RULES AND NATE'S RULES.

THE STATE SAYS THAT AS THE VALUE RISES, THE TAX RATE LOWERS.

BUT IN THIS SITUATION AND WHAT WE'RE FACED WITH AT THE MOMENT, WE'RE FACED WITH THAT SAME LOGIC FROM THE STATE, EXCEPT THE OTHER WAY, WHEN THE VALUE GOES DOWN, THE TAX RATE HAS TO RISE.

BECAUSE IN THE SAME WAY THAT THAT TAX RATE FORMULA WAS DESIGNED TO KEEP THE TAX RATE, THE TOTAL TAX IN CHECK, IT ACTUALLY ALSO GUARANTEES THAT MUNICIPALITIES HAVE THE BASIC FUNDS THAT THEY HAD THE YEAR BEFORE TO DO BUSINESS.

SO A LOT OF DUE DILIGENCE IS STILL ONGOING, BUT THE OVERALL IMPACT IS THIS YEAR'S TNT FORMULA.

TRUTH AND TAXATION FORMULA IS GOING TO LOOK QUITE DIFFERENT THAN IT HAS IN YEARS PAST.
