CITY COUNCIL DID APPROVE THE RESOLUTION FOR THE ANNEXATION AUGUST 11TH, AND TO MOVE FORWARD WITH THE ANNEXATION OF THAT RIGHT OF WAY RIGHT AWAY IS TO BE DEDICATED AND DEEDED TO THE CITY OF DECATUR. PROPERTY OWNERS NOTIFIED, 9 PROPERTY OWNERS WERE NOTIFIED.

WE HAD NO FORMAL RESPONSES. WE HAD 1 PHONE CALL INQUIRY.

GOING BACK INTO PUBLIC HEARING ON ITEM 4. WE'RE GOING TO OPEN IT UP.

WE'VE WORKED DILIGENTLY TO TRY TO GET THE ORDINANCE IN PLACE.

SO CURRENTLY XERISCAPING IS ONLY PERMITTED IN INDUSTRIAL DISTRICTS.

OF COURSE, PRINCIPLES ARE FOR WATER CONSERVATION, SOIL IMPROVEMENT TO HELP DEVELOPERS USE NATIVE SPECIES AND DROUGHT TOLERANT SPECIES FOR SUSTAINABLE MAINTENANCE. THE TEXAS LOCAL GOVERNMENT CODE, SECTION 580-002 DOES ALLOW MUNICIPALITIES TO CONSIDER ENACTING XERISCAPE ORDINANCES AND REQUIRING THE USE OF XERISCAPE TO HELP CONSERVE WATER.

SO THE PROPOSED CHANGES THAT STAFF HAS IMPLEMENTED IS ADDING DEFINITIONS INTO THIS SECTION OF THE SUBDIVISION CODE, ADDING PERMIT REQUIREMENTS FOR IRRIGATION AND BACKFLOW PREVENTION TO PERMIT IT IN ALL ZONING DISTRICTS WITH CERTAIN REGULATIONS, WE ADDED A TABLE OF PERMITTED TREES, SHRUBS AND GROUNDCOVER THAT FALL IN LINE WITH THE XERISCAPING FROM THE STATE OF TEXAS.

SO UNDER RESIDENTIAL XERISCAPE REQUIREMENT, WE ARE.

IT'S A MINIMUM PERCENTAGE OF THE TOTAL LOT AREA WHICH CAN BE DEVELOPED AND HAS TO BE DEVOTED TO TRADITIONAL LANDSCAPING BECAUSE YOU DON'T WANT ALL SOLID ROCK, ALL SOLID SHELL OR ANYTHING BECAUSE THAT ATTRACTS HEAT.

IT'S NOT REALLY GOOD FOR THE ENVIRONMENT EITHER.

SO WHAT WE'RE PROPOSING IS SINGLE FAMILY AND DUPLEX DWELLINGS HAVE 35% HAS TO BE TRADITIONAL LANDSCAPE, MULTIFAMILY 30%. ARTIFICIAL TURF SHOULD BE LIMITED TO 40% OF ANY OF THE REQUIRED LANDSCAPE AREA AND SETBACK AREA NONRESIDENTIAL, WE'RE LETTING THEM HAVE A LITTLE MORE FLEXIBILITY WITH THIS.

ONLY 10% FOR COMMERCIAL, INDUSTRIAL AND LIKE SCHOOLS, CHURCHES, PHILANTHROPIC 20%.

AGAIN, THESE ARE RECOMMENDATIONS. THIS IS NOT ADOPTED YET.

WE'RE ASKING FOR YOUR INPUT WHEN WE MOVE THIS FORWARD TO COUNCIL AND ARTIFICIAL TURF LIMITED TO 50% OF ANY REQUIRED LANDSCAPE AND SETBACK AREA ALTERNATIVE STANDARDS, WHILE THE LITTLE ASTERISK IS THERE, MAY APPLY TO PROJECTS THAT ARE ZONED AS PART OF A PLANNED DEVELOPMENT BECAUSE THEY CAN WRITE IN THEIR OWN LANDSCAPE REQUIREMENTS UNDER THE PD PROCESS.

SO. GROUND COVER. ALL DEVELOPMENT IS REQUIRED TO HAVE GROUND COVER.

USUALLY HAVE, LIKE AN ORGANIC OR A BACTERIA RESISTANT SAND THAT HELPS INFILL, LIKE IF YOU HAVE IT FOR DOG PARKS.

THAT WAY, WHEN THE DOGS DO THEIR BUSINESS, IT DOESN'T GROW BACTERIA.

THERE'S A CERTAIN TYPE OF SAND INFILL THAT YOU CAN USE THAT'S BACTERIA RESISTANT.

AND WE CAN ADD ADDITIONAL MAINTENANCE REQUIREMENTS IN THERE FOR THAT.

JUST SPEAKING FROM EXPERIENCE FROM FLORIDA, WE ADDED THE ARTIFICIAL TURF INTO OUR ORDINANCE, AND WE HAD ALL OF THOSE REQUIREMENTS. WE HAD TO HAVE IT HAD TO HAVE A CERTAIN PERCENT WEIGHTED.

IT WAS WEIGHTED NO RUBBER INFILL, BUT WE WERE ON CANAL SYSTEM, SO WE DIDN'T WANT THAT TO WASH INTO OUR CANALS.

IF IT WAS IN THE RIGHT OF WAY, THEY HAD TO SIGN A HOLD HARMLESS AGREEMENT BECAUSE IF ANY WORK WAS DONE IN A DRAINAGE RIGHT OF WAY, IT WAS NOT THE CITY'S RESPONSIBILITY TO REPLACE IT.

IT WAS THE HOMEOWNERS. THERE'S CERTAIN THINGS THAT HAS TO HAVE A PERMEABILITY BECAUSE YOU DON'T WANT IT TO TO FLOOD.

YOU WANT IT TO HAVE SUFFICIENT DRAINAGE AS WELL.

WE CAN ADD A LOT OF THAT IN THERE. IF YOU WANT TO TAKE IT OUT NOW AND TRY TO ADD IT LATER AS WE GO.
