JUST A REMINDER PALOMA TRAILS IS THE HOUSING DEVELOPMENT THAT IS EAST ON THE EAST EDGE OF THE CITY, JUST OFF OF HIGHWAY 380 AND I PUT SNIPPETS OF THEIR IMPROVEMENT AREA DOCUMENTS FROM THE PIID AGREEMENT THAT WAS EXECUTED LAST YEAR WITH PALOMA TRAILS. THE IMAGES REPRESENT WATER AND SEWER IMPROVEMENTS THAT ARE BEING PUT IN AS PART OF THE PUBLIC IMPROVEMENT DISTRICT.

HAVING THIS AD VALOREM ASSESSMENT AND COLLECTION CONTRACT BETWEEN THE CITY AND WISE COUNTY JUST SIMPLY ALLOWS FOR THEM TO ASSESS THE TAX AND THEN COLLECT IT ON OUR BEHALF.

THERE'S A CONTRACTUAL OBLIGATION THAT THE CITY WILL PAY THEM FOR THEIR SERVICES.

EACH CONTRACT HAS A VALUE OF $1,500 ON IT AND THERE FOR A YEAR TIME PERIOD, AND THEY RENEW ANNUALLY THEREAFTER, SO THAT'S KIND OF THE BASICS OF THE NEED FOR THIS AGREEMENT.

NONETHELESS, IT IS AN AGREEMENT THAT THE COUNCIL HAS OVERSIGHT ON, SO I'M HAPPY TO ANSWER QUESTIONS BUT THIS DOES TAKE SEPARATE ACTION FOR ITEM 4 THAN ITEM 5. ALL RIGHT. COMMENTS OR QUESTIONS FROM COUNCIL.

SO PUT TOGETHER A VERY SHORT SLIDE PRESENTATION HERE TO TALK ABOUT THE FRONT YARD FENCES AGAIN AND OF COURSE, THE CURRENT ORDINANCE THAT WE HAVE ON BOOKS, DIDN'T APPEAR THAT ANYBODY WAS OVERJOYED WITH THAT OUTCOME FOR WHAT THAT TURNED INTO WITH THAT, TO ALLOW CERTAIN FRONT YARD FENCES ON LOTS WITH MULTIPLE STREET FRONTAGES OR AN UNPLANNED SIDE YARDS WITH A MAXIMUM OF 6 FOOT IN THAT FRONT YARD FENCE WITH THE SETBACK OF 10 FOOT FROM THE STREET OR 5 FOOT FROM THE SIDE WALK.

IT'S A VARIANCE TO THAT ZONING ORDINANCE. IF IT PROHIBITS IT THEY CAN GO THROUGH A VARIANCE PROCESS, IT WOULD GO TO THE BOARD OF ADJUSTMENT, OF COURSE, THE BOARD OF ADJUSTMENT IS A QUASI JUDICIAL BOARD.

AND SO THAT DECISION THAT COMES FROM THE BOARD OF ADJUSTMENT WOULD NOT COME BACK TO CITY COUNCIL IT'S FINAL.

THE APPEAL TO THAT IS AT DISTRICT COURT, AND THAT'S THROUGH STATE LAW REQUIREMENTS OR PROVIDING REGULATIONS FOR FRONT YARD FENCES WHATEVER THAT MAY LOOK LIKE, YOU CAN BASE THAT ON THE LOCATION IN THE CITY, WHETHER IT'S A OVERLAY DISTRICT, A ZONING DISTRICT AND YOU CAN PROVIDE SPECIFIC REGULATIONS FOR THOSE FENCES THAT COME INTO PLAY FOR THAT.

I WANTED JUST TO KIND OF PREVIEW THESE 2 DOCUMENTS, THE MINIMUM STANDARDS, AND THEN THE RULES AND REGULATIONS YOU'LL SEE ON THE CONSENT AGENDA THAT WE'VE GONE THROUGH THE TEDIOUS STEPS OF GETTING A BOARD SELECTED.

WE'VE ALSO HAD THE UNIQUE OPPORTUNITY TO GRAB SOME ALTERNATE CANDIDATES AS WELL AND SO THROUGH THAT PROCESS, WE WANTED TO ALLOW THE AIRPORT BOARD TO SEE THESE DOCUMENTS, GIVE US THEIR RECOMMENDATIONS FOR CHANGES, CONSIDER THESE IN DRAFT FORM AT THE MOMENT. BUT WE JUST WANTED TO GIVE THAT TO YOU AND TELL YOU THAT WE'RE READY TO MOVE FORWARD WITH THE FIRST MEETING OF THE NEWLY NEWLY REVISED AIRPORT BOARD.

AND WE'RE GOING TO BE GIVING THIS TO THOSE FOLKS AS HOMEWORK DAY ONE TO HELP US GET IT IN LINE WITH WHERE THE AIRPORT COULD BE HEADED FOR THE CITY OF DECATUR.
