THEY DID SOME RESEARCH OF THEIR OWN, CAME BACK AND SAID THAT THEY WOULD LIKE TO SEE A SUP IN PLACE TO ALLOW ZONING OR THE ZONING CHANGE BY SUP FOR TATTOO PARLORS AND THAT DOWNTOWN ZONING DISTRICT. THERE'S SOME PRECEDENT WITH THAT WITH SOME OTHER CITIES. DENTON IS ONE THAT'S CLOSE BY THAT YOU CAN SEE THAT ON AND THEN THEY'VE NAMED OFF SEVERAL OTHERS. THE WHOLE PURPOSE OF THE DOWNTOWN ZONING DISTRICT IS TO BRING MORE PEOPLE INTO THAT AREA AND SO AND CREATE MORE COMMERCE IN THE DOWNTOWN AREA AND THEY FEEL LIKE THIS WOULD MEET THAT GOAL BY ALLOWING THIS USE IN THERE, BUT AT THE SAME TIME, NOT CHANGING THAT ZONING DISTRICT TO C-2 TO ALLOW SOME OTHER USES DOWN THERE THAT WOULD BE ALLOWED IN THE C-2 ZONING DISTRICT. SO IT WOULD STILL MAINTAIN THAT HISTORIC FEEL AND USE THAT'S ALREADY IN PLACE RATHER THAN CHANGING IT TO C-2. SO THAT COVERS THE TATTOO PARLOR PART OF IT. THE OTHER PART OF THIS IS THE VAPE SHOPS AND SMOKING SHOPS. WE HAD A DEVELOPER OR A STORE OWNER THAT WAS RESEARCHING DECATUR TO SEE WHERE THEY, THESE SHOPS WERE ALLOWED. WE GOT TO LOOKING AT THIS AND FOUND OUT THAT THEY WERE ALLOWED AS GENERAL RETAIL STORES IN ANY OF THE ZONING DISTRICTS THAT WERE COMMERCIAL. WITH THE ONLY EXCEPTION BEING POSSIBLY CO, BECAUSE THAT ZONING DISTRICT DOES NOT ALLOW FOR READY INVENTORY TO BE ON HAND. SO WE LOOKED AT THE VAPE SHOPS. THE MAIN CONCERN THAT WE HAD WITH THE VAPE SHOPS ARE THE BATTERIES THAT COME WITH THESE VAPE PENS. THERE'S BEEN LOTS OF INCIDENCES OF EXPLOSIONS AND FIRES THAT HAVE BEEN STARTED BECAUSE OF THE LARGE SCALE STORAGE OF THESE BATTERY DEVICES THAT ARE STORED THERE AND SO WHAT WE DID IS WE ADDED THOSE IN AS THEIR OWN LINE ITEM IN THE SMOKE AND VAPE SHOP FOR A C-1, C-1A, WITH AN SUP, AND THEN BY RIGHT IN C-2, LI AND PD. SO A NEW USE CATEGORY WAS CREATED FOR SMOKE AND VAPE SHOPS FOR SUP IN THE CO, C1, AND C1 DISTRICTS AND ALLOWED BY RIGHT IN C2, LI AND PD. OF COURSE, WE TALKED ABOUT THE CO ZONING DISTRICT NOT ALLOWING THE READILY INVENTORY TO BE ON HAND, AND OF COURSE, THE ADDITIONAL USE WITH AN SUP IN THOSE MORE RESTRICTED ZONING DISTRICTS WOULD ALLOW FOR MORE REGULATIONS TO BE ADDED IF NECESSARY.
