HERE, THE CITY OF DECATUR'S REQUEST TO AMEND THE COMPREHENSIVE PLAN AND THE FUTURE LAND USE MAP FROM COMMUNITY COMMERCIAL. LAND USE DESIGNATION TO ACTIVITY CENTER, APPROXIMATELY 7.795 ACRES OF LAND LOCATED WEST OF US 287 AND NORTH OF WALNUT STREET IN DECATUR, TEXAS.

PROPERTIES ARE MORE COMMONLY REFERRED TO AS 201 THROUGH 217 NORTH CHICO STREET.

THE PROPERTY CURRENTLY HAS LAND USE DESIGNATION OF COMMUNITY COMMERCIAL.

HOWEVER, CITY OF DECATUR IS REQUESTING THAT SUCH DESIGNATION BE AMENDED TO ACTIVITY CENTER.

LAND USE DESIGNATION, BASED ON THE PROPERTY'S LOCATION AND THE PROPOSED FUTURE USE AS MULTIFAMILY DEVELOPMENT.

SURROUNDING LAND USES ON ALL SIDES ARE COMMUNITY COMMERCIAL EXCEPT FOR ON THE EAST, WHICH ALSO HAS SOME DOWNTOWN.

THE APPLICANT IS REQUESTING THAT THE LAND USE CHANGE FROM COMMUNITY COMMERCIAL LAND USE DESIGNATION TO ACTIVITY CENTER.

LAND USE DESIGNATION IS CONSISTENT WITH THE C-2 THOROUGHFARE BUSINESS ZONING DISTRICT.

SECONDARY LAND USES ARE CIVIC AND INSTITUTIONAL USES.

UH ACTIVITY CENTER LAND USE DESIGNATION IS CONSISTENT WITH THE C-2 THOROUGHFARE BUSINESS ZONING DISTRICT, AND BEFORE ANY DEVELOPMENT MAY OCCUR, APPLICANTS WILL HAVE TO SUBMIT PLATING AND BUILDING PERMIT APPLICATIONS.

STAFF HAS CONDUCTED A REVIEW OF THE ZONING ORDINANCE AND HAVE DETERMINED THAT THE FOLLOWING AMENDMENTS ARE IN ORDER TO ACHIEVE THE OBJECTIVE OF THE DECATUR 2050 COMPREHENSIVE PLAN.

THE ZONING ORDINANCE ALLOWS MULTIFAMILY DWELLING UNITS IN SEVERAL DISTRICTS.

GENERALLY, MULTIFAMILY UNITS ARE LIMITED TO 12,000FT².

IT HAS COME TO THE ATTENTION OF CITY STAFF THAT WHEN MULTIFAMILY UNITS ARE LOCATED IN THE C-2 THOROUGHFARE BUSINESS ZONING DISTRICT, IT WOULD BE APPROPRIATE FOR THE SQUARE FOOTAGE TO EXCEED 12,000FT² IN THE C-2 THOROUGHFARE BUSINESS ZONING DISTRICT.

IN RECENT MONTHS, CITY STAFF HAS BEEN APPROACHED WITH A PROJECT FOR A MULTIFAMILY SENIOR LIVING FACILITY TO BE LOCATED IN THE C-2 ZONING DISTRICT.

CURRENTLY, THE MULTIFAMILY BUILDING WOULD BE LIMITED TO 12,000FT².

WITH THIS CHANGE, THE BUILDING COULD BE GREATER THAN 12,000FT² AS THEY HAVE SUBMITTED IT.

CITY COUNCIL AMENDED THE CURRENT ZONING ORDINANCE IN 2019 TO INCREASE THE MULTIFAMILY UNITS TO 12,000FT².

THIS CHANGE WOULD ALLOW MULTIFAMILY UNITS ONLY WHEN THEY ARE LOCATED IN THE C-2 ZONING DISTRICT, TO EXCEED 12,000FT².

ALL OTHER SAFETY AND BUILDING STANDARDS WILL STILL APPLY.

THIS CHANGE IS IN LINE WITH THE FOLLOWING DIRECTION GIVEN TO STAFF BY THE CITY COUNCIL IN 20TH OCTOBER OF 2018.

STAFF WAS GIVEN DIRECTION THAT THE LIMITATION SHOULD BE INCREASED TO PROVIDE A MORE SUITABLE MAXIMUM SIZE LIMITATION OR REMOVED.

SO THIS WOULD ONLY APPLY TO THE C TWO ZONING DISTRICT WHEN IT'S IN THAT C TWO.

ANYTHING THAT'S ZONED MULTIFAMILY WOULD STILL HAVE THE LIMITATION OF 12,000FT².

SO THAT MULTIFAMILY GENERALLY ACTS AS A BUFFER BETWEEN COMMERCIAL AND RESIDENTIAL AREAS.

AND SO THAT SIZE LIMITATION WOULD STILL BE IN PLACE FOR THAT MULTIFAMILY ZONING DISTRICT IN AC2 ZONING DISTRICT.

IT WOULD ALLOW THEM TO GO TO THE MAXIMUM ALLOWABLE SQUARE FOOTAGE BY BUILDING CODE.

WHICH IS IT VARIES DEPENDING ON THE TYPE OF CONSTRUCTION.
