OKAY. SO, THIS IS VARIANCE NUMBER 20, 2313, WHICH IS A VARIANCE REQUEST FOR SIDEWALK ALONG HOLMAN STREET, I THINK IT WAS IN 2023-14 IS THE VARIANCE REQUEST ALONG SHOEMAKER STREET.
THE PROPERTY IS KNOWN AS 301 SOUTH HOLMAN.
WE ASKED FOR QUESTIONS, TO DETERMINE IF THE VARIANCE IS ALLOWABLE.
NUMBER ONE, THAT THERE ARE SPECIAL CIRCUMSTANCES OR CONDITIONS AFFECTING THE LAND INVOLVED, SUCH THAT STRICT APPLICATION OF THE PROVISIONS OF THE ORDINANCE WOULD DEPRIVE THE APPLICANT OF THE REASONABLE USE OF LAND.
AND WHAT I FOUND IS THAT THE PROPERTY IS LOCATED AND SURROUNDED BY SINGLE FAMILY DEVELOPMENT.
THIS PROPERTY WAS PART OF THE ORIGINAL CITY OF DECATUR, MAPPED ABOUT 1898.
THE REPLAT IS BEING PREPARED TO ALLOW THE ISSUANCE OF A BUILDING PERMIT.
THE AREA IS GENERALLY BUILT OUT.
SIDEWALKS DO EXIST IN THE NEIGHBORHOOD, BUT THERE ARE OVER A BLOCK AWAY ON SOUTH STATE STREET.
NO SIDEWALKS EXIST ALONG SOUTH HOLMAN STREET OR SHOEMAKER.
THE ADDITION OF A SIDEWALK ALONG SOUTH HOLMAN OR WEST SHOEMAKER SHOULD NOT AFFECT THE PROPERTY RIGHTS OF THE OWNER BUT SERVE NO USEFUL PURPOSE BY PROVIDING ANY CONTINUITY FOR SIDEWALKS.
SOUTH HOLMAN AND WEST SHOEMAKER STREETS ARE CONSIDERED LOCAL STREETS, THEREFORE GRANTING OF A VARIANCE WILL NOT BE IN CONFLICT WITH THE DECATUR 2050 LONG RANGE MASTER PLAN.
AND THEN THE FOURTH QUESTION THAT THE GRANTING OF THE VARIANCE WILL NOT HAVE THE EFFECT OF PREVENTING THE ORDERLY SUBDIVISION OF OTHER LAND IN THE AREA IN ACCORDANCE WITH THE PROVISIONS OF THE ORDINANCE.
MY FINDING IS THAT THE AREAS SURROUNDING THE PROPERTY IS GENERALLY BUILT OUT A FUTURE REPLATTING OF SURROUNDING PROPERTIES THAT WOULD REQUIRE CONSTRUCTION OF SIDEWALKS WOULD OCCUR IN A RANDOM FASHION.
IT'S NOT REASONABLE TO EXPECT ALL PROPERTIES TO HAVE SIDEWALKS UNLESS THE CITY DID A COMPREHENSIVE PROJECT IN THE NEIGHBORHOOD IN GRANTING OF THE VARIANCE WOULD NOT BE IN CONFLICT WITH THE LONG RANGE MASTER PLAN.
AND MR. CHAIRMAN, I DIDN'T PREPARE A MAP FOR YOU BECAUSE THERE WASN'T ANYTHING TO SEE.
